Ultra Drive Terms And Conditions

These terms and conditions ("Terms") govern the relationship between the driving instructor ("Instructor") and the learner driver ("Student") for driving instruction services provided by the ultra drive Instructor.

1. Services Offered

1.1. The Instructor agrees to provide driving instruction services to the Student in compliance with the dvsa laws and regulations.

1.2. The services may include, but are not limited to, practical driving lessons, theory instruction, and guidance for driving tests.

2. Payment and Fees

2.1. The Student agrees to pay the agreed-upon fees in advance for each driving lesson, as specified by the Instructor.

2.2. Payment must be made in advance or as agreed upon between the Instructor and the Student.

2.3. Bulk booking payments can book more than one lesson at a time, please refer below to section 3.4.

3. Scheduling and Cancellation

3.1. Lessons should be scheduled in advance and are subject to availability.

3.2. The Student must provide at least 48 hours' notice for any lesson cancellation. Failure to provide adequate notice will result full change of the lesson cancelled. .

3.3. The Instructor reserves the right to cancel or reschedule lessons due to unforeseen circumstances.

3.4. Your request to the Instructor will be an offer to book a lesson, but whether the offer is accepted with be at the Instructors discretion. only if the Instructor accepts the offer the booking will be placed and will be visible in the Ultra Drive app. Nothing will be confirmed until you get a notification or the booking is visible in the app. any questions please refer to your Instructor.

3.5. If You know you’re going to be late for a lesson please provide as much notice as possible to your Instructor, if you arrive or are not ready later then 15 minutes of your scheduled lesson, the instructor will try to conduct the lesson, but if the instructor decides the lesson cannot be conducted it will be treated as cancelled without notice and full fee will be charged as per section 3.2.

3.6. You can cancel any booking you have made 48 hours in advance of the booking time. if your lesson can be rescheduled or a refund can be made by your Instructor for any advance payments made, if you cancel the lesson within the 48 hour window of your agreed booking, the Instructor has the right to charge you fully, or charge you a fee to cover their losses.

3.7. Due to unforeseen circumstances but not limited to, illnesses, immediate family deaths, accidents, etc. you can cancel a booked lesson without the 48 hours notice, The Instructor will consider the circumstances and will be as understanding to your needs as much as possible, they will try to fill that booked slot with another student to cover their losses. if the timed slot is covered there will be no charge to you for that booked lesson.

3.8. If you instructor cancels the lesson for any reason you will not incur any charges for that booking. The Instructor can cancel up to the time of the booking without incurring any liability.

3.9. The Instructor will try his upmost to start the lesson on time (normally an Instructor will arrive early, ready for you at the time of your lesson), if for any reasons there is a delay (overrun of another lesson, traffic delays, etc) the Instructor will notify you if they are going to be more than 15 minutes late. Please allow the 15 minute window for your Instructor to arrive. the Instructor will arrange your lesson to overrun for the time they are delayed or suitable agreement will be made to make the time up in the future. If your Instructor arrives more than 15 minutes late without any communication you are welcome to rebook another time or ask for a refund for the advance payment.

3.10. You the Student are required by law to read a numberplate at a distance of 20 metres. this would be with or without glasses, if needed. Failure to read a number plate at the distance will conclude to you not legally being allowed to drive the vehicle and the lesson will be charged at full rate.

4. Conduct and Behavior

4.1. The Student agrees to behave in a respectful and attentive manner during all lessons. the Instructor is within his rights to terminate a lesson if they feel in any way under threat, danger or any misconduct.

4.2. The Instructor reserves the right to terminate a lesson but not limited to, if the Student is engaged in unsafe behaviour or is under the influence of drugs or alcohol. Whether prescribed or not.

4.3. The Instructor will create a positive and safe environment for the Student to learn in a safeguarded measured environment with full respect to boundaries and wellbeing. The Instructor will expect the same treatment.

5. Safety and Vehicle Use

5.1. The Instructor will provide a safe and properly maintained vehicle for driving lessons.

5.2. The Student agrees to follow all safety instructions provided by the Instructor during lessons.

6. Liability and Insurance

6.1. The Instructor shall maintain appropriate liability insurance coverage for the driving instruction vehicle.

6.2. The Student is responsible for any damage caused to the Instructor's vehicle during a driving lesson/test due to negligence or improper use.

6.3 The Student will be liable for any parking, speeding fines or prosecutions, the instructor will always advise of potential risks before they will arise but it is the students liability to accept all fines or penalties that result of this, during the times of their lessons or driving test.

7. Confidentiality and Privacy

7.1. Both parties agree to maintain the confidentiality of any personal or sensitive information shared during lessons.

7.2. The Instructor may use and retain personal information for the purpose of providing driving instruction and complying with legal obligations.

7.3 Your driving instructor will ask to provide a ‘driving licence check code’ so that they can check your driving licence. The ‘check code’ can be obtained at: https://www.gov.uk/view-driving-licence To get this code you will need your driving licence number and national Insurance number. The code lasts for 21 days and can only be used once. For the instructor to look at the code they will need you to supply them with your share code and the last 8 characters of your driver number which can be found on your driving licence. please send this information directly to your Instructor.

8. Termination of Services

8.1. Either party may terminate the driving instruction services by providing suitable notice. The Instructor may terminate your tuition if your conduct, progress or commitment consistently falls below the standards that the Instructor reasonably expect.

8.2. In the event of termination, any advance payments will be refunded to the Student, minus any applicable fees.

9. Complaints

9.3. The instructor is trained to a very high standard in regards to your tuition and service. although we always consider our customers as Students and our Instructors as coaches. we always welcome feedback good or bad, if there is any issue, please do not hesitation to contact us and provide any feedback. Any complaint should be addressed to your instructor and they will endeavour to resolve this amicably, if the situation isn't resolved directly You should make all efforts to contact us in writing to:

9.4. Your complaint will be acknowledged within 3 working days, following investigation, a satisfactory outcome or decision will be made. any further dispute should or will be resolved within 28 days.

10. Law & Data Protection

10.1. These Terms shall be governed by the laws of England and Wales.

10.2. Any disputes arising from or relating to these terms shall be subject to the exclusive jurisdiction of the courts in England and Wales. By agreeing to these terms and conditions, both parties acknowledge that they have read, understood, and agreed to be bound by the terms herein.

10.3.How We Use Your Personal Information (Data Protection)

10.4. To provide and carry out driving tuition and any other services for You, thus involves Us in collecting, using, or holding or otherwise processing any data obtained from You which is personal data (including, but not limited to, Your name and address), We shall only do so with Your consent.

10.5. To provide driving lessons and coaching or other services.

10.6. To Your driving instructor to provide a service to you.

10.7. To process Payment or other Services.

10.8 We will not pass on Your personal information to any other third parties, without first obtaining Your immediate permission. we do not have the need to pass on any information on a typical basis.
